The Supreme Court has issued a ruling in the case Whole Woman’s Health et al. v. Jackson.

The court will allow a pre-enforcement challenge to Texas’s fetal heartbeat law S.B.8 to continue in court.

Context: The court ruled that abortion providers in Texas can sue some state officials in federal court.

However, the Supreme Court will not block the law by issuing an injunction in the meantime.


What this means: The justices followed their ruling from September 1st that left the rule in effect, but took it further and addressed the challenges.

The court was not tasked with deciding the constitutionality but rather whether the law could be challenged by providers in state or federal court.

What is next?: The law will not face challenges in the lower courts and could make its way back to the Supreme Court.
