The Biden Department of Justice is reversing a previous Trump admin finding and allowing federal convicts sent home during the pandemic to serve the remainder of their sentences at home.

Context: The Trump administration had found that inmates released during the pandemic would need to return back to prison once it was deemed safe to do so.

The Biden DOJ has reversed that decision and now those inmates will not have to return to prison.

What this means: The previous rule could have sent the prisoners back en masse once the state of emergency was lifted.

However, now it is at the discretion of the Federal Bureau of Prisons whether inmates have to return on a case by case basis.


Since March of 2020 more than 35,000 inmates have been placed on home confinement and of those 8,000 are currently still serving time at home. The others finished their sentences.
