New York Attorney General Letitia James is moving to dismiss a lawsuit from Donald Trump.

Background: Letitia James has been investigating the Trump Organization over potential charges of fraud. James claims the Trump Organization intentionally valued multiple assets and misrepresented those values to financial institutions for economic benefit.

In December, Trump filed an injunction that would block James’s investigation into the business.

“The investigations commenced by James are in no way connected to legitimate law enforcement goals, but rather, are merely a thinly-veiled effort to publicly malign Trump and his associates,” Trump’s lawsuit reads. “Her mission is guided solely by political animus and a desire to harass, intimidate, and retaliate against a private citizen who she views as a political opponent.” (per The Hill)

In early January, James issued subpoenas to Trump’s children Ivanka and Donald Jr. Both have said they do not intend to comply with the request to testify.

What Happened: Letitia James has asked a federal judge to dismiss Trump’s lawsuit arguing the former president has not sought to appeal any of the state court rulings ordering his family business to comply with the investigation.

What Letitia James says: “This lawsuit is nothing but a baseless and meritless collateral attack by Donald Trump to stop our legal and legitimate investigation into his and the Trump Organization’s financial dealings,” James said in a statement to the Washington Examiner. “In the three years that we have been conducting this investigation, the Trump Organization and its principles have never challenged the legality of the investigation, until now, when Mr. Trump himself was subpoenaed to testify.”
