On Monday, the Supreme Court refused to hear a challenge regarding a Catholic hospital’s refusal to perform transgender surgery. The decision left in place a lower court’s ruling that sided with Evan Minton, a transgender man. Minton sued Dignity Health after the hospital refused to perform his hysterectomy.

What is happening: Minton received the transgender surgery three days later at a non-religious hospital but filed a lawsuit in California claiming he was discriminated against by the Catholic hospital. The lower court ruled in Minton’s favor, which asked the Supreme Court to review the case.

Why it’s important: Since the lower court ruling stands, the Supreme Court’s refusal to take the case means Catholic and other Christian hospitals that reject transgender surgery may be in peril of being forced to do these types of surgery. Despite many SCOTUS justices being Catholic, including Trump-appointed Justices Amy Coney Barrett and Brett Kavanaugh, there seems to be a disconnect.
